By engaging with the services provided by Alysse Valiante Fine Art, including custom art commissions, in-person art sessions, live wedding painting, and speaking engagements, you agree to the following terms and conditions. These terms govern your relationship with Alysse Valiante Fine Art, and you are advised to read them carefully.

1. General Agreement
These Terms and Conditions apply to all services, including but not limited to artwork commissions, art sessions, wedding painting, and speaking engagements. By commissioning artwork or booking any service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2. Custom Artwork Commissions

• Request and Approval: Custom artwork commissions require a detailed discussion between the client and the artist. Once the request is made, the client will receive a proposal outlining the scope, pricing, and timeline for the project. The client must approve the proposal in writing before work begins.

• Pricing: The price of commissioned artwork will be agreed upon before work begins. A deposit may be required to start the project, with the balance due upon completion.

• Revisions: Clients are entitled to a limited number of revisions as specified in the proposal. Any additional revisions may incur extra charges.

• Delivery: Delivery timelines for custom artwork will be provided at the time of approval, but may vary based on complexity and scope. The client will be notified of any delays.

• Non-refundable Deposit: A deposit is required to begin the project. Once work has started, the deposit is non-refundable, regardless of any cancellation.

3. Live Wedding Painting and Event Services

• Booking: To book Alysse Valiante Fine Art for live wedding painting or event services, a signed contract and deposit are required. Final payment is due before or on the day of the event unless otherwise agreed upon.

• Event Cancellations: In the event of a cancellation, the client must notify Alysse Valiante Fine Art at least 30 days before the event to receive a partial refund of the deposit. Cancellations made within 30 days of the event are non-refundable.

• Artwork Completion: While every effort will be made to complete the live painting during the event, some details may require additional time after the event to finish. Final delivery of the painting will be arranged between the artist and the client post-event.

• Event Liability: Alysse Valiante Fine Art is not responsible for any interruptions, accidents, or damages that may occur during the event. The client is responsible for ensuring the artist has a suitable location and space to work.

4. Payment Terms

• Invoices: All payments for commissioned artwork, events, or other services must be made according to the payment schedule outlined in the proposal or contract.

• Payment Methods: Payments can be made via credit card, bank transfer, or other methods agreed upon with Alysse Valiante Fine Art.

• Late Payments: Any late payments may be subject to an additional fee. Alysse Valiante Fine Art reserves the right to pause work until outstanding payments are received.

5. Copyright and Ownership

Intellectual Property: The artwork created by Alysse Valiante Fine Art remains the intellectual property of the artist unless otherwise agreed upon in writing. The client may use the artwork for personal or commercial purposes as specified in the contract.

Reproduction Rights: Alysse Valiante Fine Art reserves the right to reproduce images of the completed artwork for promotional purposes, including social media, portfolio, and other marketing materials, unless the client requests otherwise in writing.

6. Cancellation and Refund Policy

Custom Artwork: Once a project has commenced, the deposit is non-refundable. If a client cancels the project after work has started, the client remains responsible for any costs incurred by the artist up to the point of cancellation.

Event Services: If the client cancels a scheduled event or wedding painting within 30 days, the deposit will not be refunded. Cancellations made earlier may receive a partial refund based on the terms agreed upon in the contract.

Refunds: Due to the nature of custom artwork and event-based services, refunds are not provided unless otherwise agreed in writing by Alysse Valiante Fine Art.

7. Client Responsibilities

Communication: Clients are responsible for providing clear, accurate information about their art preferences, event details, and any special requests in a timely manner. Failure to provide necessary details may result in delays or additional fees.

Event Logistics: The client is responsible for ensuring that the artist has access to the venue, suitable workspace, and any necessary accommodations for events or art sessions.

Health and Safety: Clients attending in-person sessions or events must comply with any safety protocols outlined by the artist, including but not limited to health, safety, and venue guidelines.

8. Limitation of Liability
Alysse Valiante Fine Art is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of its services. This includes but is not limited to damage to property, injury, loss of income, or loss of artwork. Clients agree to indemnify and hold harmless Alysse Valiante Fine Art from any such claims.

9. Privacy and Confidentiality
Any personal information provided by the client will be handled according to our Privacy Policy, which can be reviewed at any time. We are committed to maintaining confidentiality and respecting your privacy.

10. Modifications to Terms and Conditions
Alysse Valiante Fine Art reserves the right to amend or update these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services after such modifications will constitute acceptance of the updated terms.

11. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by the laws of the state or jurisdiction where Alysse Valiante Fine Art is based. Any disputes arising out of these terms will be resolved through mediation or arbitration, as agreed upon by both parties.
