By using the services of Alysse Valiante Fine Art, including custom artwork commissions, in-person art sessions, live wedding painting, and speaking engagements, you acknowledge and agree to the following terms:
1. Artistic Interpretation and Custom Work
Custom artwork commissions are based on your preferences and input; however, all pieces are subject to the artist's unique style, creativity, and interpretation. While every effort is made to align the artwork with your expectations, the final product may vary in color, style, and composition due to artistic discretion.
2. Event and Session Performance
For live wedding painting and other event-related services, the artist will perform to the best of their ability, capturing the event’s essence. However, environmental factors, such as lighting, weather conditions, or time constraints, may impact the artist’s ability to complete the work as initially envisioned. The artist is not liable for any interruptions or delays beyond their control.
3. No Guarantees on Timeframe
While estimated completion times for custom artwork or event-related services will be provided, due to the creative process and the varying nature of commissioned work, specific timelines cannot be guaranteed. All clients will be updated on the status of their commissions or services as needed.
4. Image Usage and Copyright
All artwork produced by Alysse Valiante Fine Art remains the intellectual property of the artist unless otherwise agreed upon in writing. The client may use the artwork for personal or commercial purposes as specified in the contract. Unauthorized reproduction, resale, or distribution of artwork without prior permission is prohibited.
Alysse Valiante Fine Art reserves the right to use images of completed artwork for promotional purposes, including but not limited to social media, portfolio, and advertising, unless otherwise requested in writing by the client.
5. Payment and Refund Policy
All payments for commissioned artwork or services must be made according to the agreed-upon terms. Once work on a custom piece has begun or an event has been scheduled, refunds are not available. Cancellations may be subject to fees depending on the timing of the request. Specific payment terms will be outlined in the contract.
6. Health and Safety During In-Person Sessions
Clients attending in-person art sessions, workshops, or events should take full responsibility for their own health and safety. Alysse Valiante Fine Art is not liable for any injury, loss, or damage to personal property during any event or session. Clients must inform the artist of any special considerations or requirements they may have for the session.
7. Website Content and Accuracy
While Alysse Valiante Fine Art makes every effort to ensure that all content on the website is accurate, complete, and up to date, we do not guarantee the accuracy or reliability of the information presented. The website may contain links to third-party sites or resources; Alysse Valiante Fine Art is not responsible for the content or practices of any linked websites.
8. Limitation of Liability
In no event shall Alysse Valiante Fine Art, including its officers, employees, or affiliates, be held liable for any indirect, incidental, or consequential damages arising out of the use of our services, whether caused by negligence, breach of contract, or any other legal theory.
